In February 2022 a vehicle registered to our client was captured speeding by a traffic enforcement device. Our client, a registered company, failed to nominate a driver within the allocated time frame and pleaded guilty to the offence of fail to supply details of driver- corporation – second offence, contrary to section 188(1) of the Road Transport Act 2013. The maximum penalty for this offence is $20,000.
In October 2022 our criminal lawyers represented our client at their sentence proceedings at the Downing Centre Local Court. Initially, the Magistrate indicated that he was considering issuing a $6,000 fine. However, after hearing our criminal lawyers’ submissions on the circumstances surrounding the failure to nominate a driver, the Magistrate ordered that our client pay a fine of $2,000.
