Man avoids prison sentence after skull-fracturing assault

In March 2020, our client was arrested after having knocked a man out and fractured his school in a drunken on-punch attack at an Illawarra pub.  He was charged with the following offences: 

  • Recklessly cause grievous bodily harm, contrary to section 35(2) of the Crimes Act 1900; and
  • Assault occasioning actual bodily harm, contrary to section 59(1) of the Crimes Act 1900.

Hanna Legal engaged in negotiations with the prosecution, leading to the withdrawal of the grievous bodily harm charge and the amendment of facts sheet in his favour.

Our criminal lawyers represented our client at his sentence proceedings, where we successfully argued that he should be sentenced to an intensive corrections order and not a sentence of full-time imprisonment.
