Murder charge dismissed after trial

In 2018, our client was charged with the murder following what the police alleged was a “vicious attack” that caused the death of the deceased.

For more information, see: Man charged with murder after fatal assault in Lurnea park in Sydney’s south-west, ABC News, 13 August 2018.

Our criminal lawyers engaged in preliminary negotiations with the prosecution, following which the prosecution downgraded the charge from murder to manslaughter.

Our client pleaded not guilty to the manslaughter charge and Hanna Legal represented him at his trial before a jury at the Sydney District Court.  The central issue at the trial was whether or not our client’s assault was responsible for the death.  After a lengthy trial, the jury was discharged after it failed to reach a verdict.

We then engaged in further negotiations with the prosecution, resulting in the charge of manslaughter being withdrawn in exchange for our client pleading guilty to a charge of assault occasioning actual bodily harm and a charge of intimidation.

Hanna Legal represented our client at his sentence proceedings, where we successfully argued that he should receive no further penalty.
