Successful appeal against conviction for aggravated break and enter charge

In 2017, four brothers engaged Hanna Legal to appeal against their conviction for an offence of aggravated break, enter and commit serious indictable offence. The four men had been found guilty by a jury following a trial at the NSW District Court.

Our criminal lawyers filed an appeal and instructed Peter Lange of counsel on the appeal, which was heard in August 2017. The appeal was based on a single ground, namely, that the trial judge had made an error when she directed the jury that if a person intends to commit an unlawful act at the time that they are given permission to enter the house, then there is a breaking.

On 1 September 2017, the NSW Court of Criminal Appeal handed down its decision. The Court ruled in favour of our clients, upholding the appeal and quashing the convictions against our client.
