In January 2023, the police applied for an apprehended domestic violence order (ADVO) against our client, who is a child. The police did this after a physical altercation between our client and his brother and despite the fact that our client’s brother and parents did not request or want any ADVO.
On 21 February 2023, we attended the Surry Hills Children’s Court for the first mention of the case. There, we successfully applied for the ADVO application to be dismissed on the basis that the “person in need of protection” held no fears. Despite it being the first mention, the Magistrate heard the application and dismissed the ADVO application.
