In December 2022, our client was stopped and searched by police. They found 6 bags of cocaine and 5 bags containing MDMA in his pocket. Our client admitted to possessing the drugs and told the police that he had just purchased them for $2,800.
He was charged and pleaded guilty to 2 counts of possess prohibited drug, which is an offence against section 10(1) of the Drug Misuse and Trafficking Act 1985 (NSW).
On 27 February 2023, Hanna Legal appeared in the Waverley Local Court for his sentence hearing. After reading the material, the Magistrate immediately stated that a non-conviction was extremely unlikely, due to the amount of drugs.
However, after lengthy submissions, including about the client’s contribution to the community and his rehabilitation, the Court ultimately agreed to not record a conviction.
Instead, the Court placed our client on a Conditional Release Order requiring him to be of good behaviour for 2 years, without recording a criminal conviction.
