In December 2019, our client was charged in Western Australia with three counts of trafficking prohibited drugs, namely methylamphetamine and cocaine, contrary to section 6(1)(c) of the Misuse of Drugs Act 1981 (WA). This offence carries a maximum penalty of life imprisonment.
Our client pleaded not guilty and the matter was listed for trial at the Perth District Court.
In the lead up to the trial, our criminal lawyers engaged in negotiations with the prosecution, during which we identified deficiencies in the police evidence and issues that the prosecution would face with the admissibility of evidence.
The prosecution ultimately agreed to withdraw all of the charges against our client and, accordingly, the charges were dismissed.
