Assault charges withdrawn after successful negotiations

In August 2021, our client was charged with common assault contrary to s 61 of the Crimes Act 1900, which holds a maximum penalty of two years imprisonment. The client was involved in a domestic dispute that led to an incident of pushing.  

On the day of the hearing, our criminal lawyers negotiated with the prosecution to withdraw the charges on the basis that our client accepts an Apprehended Domestic Violence Order for 4 months on a without admissions basis. 

The prosecution agreed and the common assault charge was withdrawn and dismissed.
