In 2022, our client was arrested and charged in relation to allegations that he had committed two sexual assaults against a woman he knew more than 30 years ago.
The charges were under the now-repealed section 61D of the Crimes Act 1900.
He denied the sexual assault and instead claimed that he and the woman had participated in a consensual affair.
Our criminal lawyers conducted extensive research to obtain evidence that supported our client’s contention that he had been in a consensual relationship with the alleged victim. The evidence included photographs and the testimonies of various witnesses.
In March 2023, our client stood trial before a jury at the Parramatta District Court. After hearing all of the evidence and arguments, the jurors were unable to reach a verdict and so the jury was discharged.
The Director of Public Prosecutions decided to proceed with a retrial.
In September 2023, our client’s retrial took place. This time, the jury took less than two hours to return verdicts of not guilty to both charges.
